1. Who we are
HomeCare Maintenance and HomeCare Property Maintenance are trading names of OJS Home Care Ltd (“HomeCare”, “we”, “us” or “our”), a private limited company registered in England and Wales under company number 16940929. Our registered office is 31 Lee Warner Road, Swaffham, England, PE37 7GD.
You can contact us at info@homecaremaintenance.co.uk, on 07904 790469, or by post at our registered office.
2. These terms and the contract
These terms apply to the HomeCare Essential membership purchased through our website and Stripe checkout. They form the contract between you and us together with the plan description and the information shown immediately before you subscribe.
Before Stripe checkout, you must sign in to your HomeCare account and tick the required acceptance box. We record the terms version, your account identifier, and the date and time of acceptance. You then continue to Stripe, where completing checkout creates an obligation to pay.
Your contract begins when Stripe confirms your first payment and we send or make available confirmation of your membership. If we cannot accept the membership, for example because the property is outside our service area, we will tell you and refund payments received.
3. Eligibility and the covered property
- You must be aged 18 or over and be a consumer purchasing for mainly personal use.
- The membership covers one accepted domestic property within our service area. It is not intended for commercial premises, communal blocks or properties presenting unusual or specialist risks unless we agree otherwise in writing.
- You must own the property or have authority from the owner to arrange the services.
- Membership is personal to you and the covered property. It cannot be transferred without our written agreement.
We may ask for the property address and relevant access or safety information before confirming eligibility.
4. Price, payment schedule and failed payments
The first-year membership costs £9.99 per month for 12 monthly payments, a total of £119.88. The price includes VAT if VAT is chargeable. Stripe collects the payments using the payment method you provide. The first payment is taken when you join and the remaining payments are normally taken monthly on the corresponding date.
If a payment fails, Stripe or HomeCare may retry it and contact you. We may pause membership benefits while an amount is overdue. We will give you a reasonable opportunity to update your payment method before ending the membership. We do not charge a separate failed-payment fee.
No payment for extra work is due unless we have first explained the price or pricing basis and you have approved it.
5. What the membership includes
5.1 Annual Home Health Check
One visual, non-invasive check of reasonably accessible parts of the covered property during the membership year. We provide a practical summary of visible observations and suggested maintenance priorities.
The check is not a structural survey, building survey, valuation, insurance inspection, gas safety check, electrical installation condition report, drainage survey, damp survey or guarantee that a property is free from defects. We do not move heavy furniture, open up the building fabric or inspect areas that cannot be reached safely.
5.2 Up to 30 minutes of minor maintenance
During the same appointment, we provide up to 30 minutes of labour for one or more suitable minor tasks agreed with you. The time includes reasonable set-up, assessment and making the work area safe. Tasks depend on access, safety, the tools and materials available, and the competence legally required.
Unused time has no cash value, cannot be carried forward and cannot be exchanged for another benefit. Parts and materials are not included unless we expressly say so.
5.3 Priority routine booking
We prioritise members when allocating suitable routine appointments. This does not guarantee a specific date, response time or immediate attendance, and it does not apply to emergency or out-of-hours work.
5.4 10% off eligible labour
The discount applies to qualifying general maintenance labour supplied directly by HomeCare during an active membership. It does not apply to parts or materials, emergency or out-of-hours charges, specialist or subcontracted work, statutory inspections, fixed-price packages, work already discounted, or work for another property. We confirm eligibility in the relevant quote. Discounts cannot be combined unless we agree otherwise.
6. Exclusions
The membership does not include emergency attendance, repairs following a breakdown, fault diagnosis beyond the visual check, parts, materials, waste removal, access equipment, parking or permit costs, additional labour, or specialist services.
The included maintenance time cannot be used for gas work; asbestos or other hazardous materials; live electrical work or work requiring certification; structural work; roofing or unsafe work at height; invasive investigation; pest treatment; drainage excavation; work in contaminated, unsafe or inaccessible areas; or any task we reasonably consider unsuitable for a short maintenance visit.
We may stop or decline work if there is an immediate safety risk, abusive behaviour, unlawful instructions, undisclosed hazards, unsafe access, or a need for a differently qualified contractor. We will explain the reason and, where appropriate, suggest a next step.
7. Booking and access
Membership services do not start during the 14-day cooling-off period. You may request the annual appointment from day 31. Appointments are subject to reasonable availability, location, weather, safe access and the trade required. Contact us in enough time for the visit to be completed before the membership year ends.
We will make reasonable efforts to remind you about the included visit. If you ask in time but we cannot offer a reasonable appointment within the membership year, the benefit will remain available until we can provide it. If you do not respond to reasonable contact or do not request the appointment in time, the benefit normally expires at the end of the membership year.
An adult authorised to make decisions must be present unless we agree another arrangement. You must provide safe access, disclose known hazards and secure pets. Please give at least 24 hours’ notice to rearrange. For repeated missed appointments or late cancellations, we may treat the included visit as used to the extent of our reasonable wasted time or costs, but we will consider exceptional circumstances.
8. Extra work and separate quotes
If we identify work outside the membership, we may provide a separate quote. You are not required to accept it. Any accepted quote may have its own job-specific terms, scope, exclusions and payment schedule. The membership discount applies only where the quote says it does.
9. Your 14-day cooling-off right
You may cancel without giving a reason within 14 days beginning the day after the contract is made. Because we do not provide membership services during that period, we will refund all membership payments received.
To cancel, make a clear statement by email to info@homecaremaintenance.co.uk, by telephone on 07904 790469, or by post to OJS Home Care Ltd, 31 Lee Warner Road, Swaffham, England, PE37 7GD. Include your name, property address, contact details and the date you joined. You may use the model wording in section 18, but you do not have to.
We will refund money due within 14 days of being told that you are cancelling, using the original payment method unless you expressly agree otherwise.
10. Ending the membership after the cooling-off period
You may ask to end the membership early at any time by using the contact details in section 9. We will not impose a penalty simply for cancelling.
If the annual visit has not been supplied, we will normally stop future monthly payments after the current paid monthly period and the remaining membership benefits will end.
If the annual visit or another included service has already been supplied, we may make a fair closing-account charge for the reasonable value of the included services you received, less membership fees already paid. Before the annual visit starts, we will tell you the non-member price that would be used for this calculation. Any closing-account charge will never exceed the unpaid balance of the 12-month membership price. No closing-account charge limits your statutory rights or applies where you end because we have materially breached the contract.
We may end the membership on reasonable notice if you repeatedly fail to pay, misuse the membership, provide materially false information, act abusively, create an unsafe situation, or the covered property is no longer eligible. We will act proportionately and refund any prepaid amount for services that will not be supplied, less any lawful amount due.
11. End of the 12-month term and renewal
The membership ends after the 12-month payment schedule. It does not renew automatically. We may contact you with a renewal offer, including the price and terms then available. A new membership starts only if you actively accept the offer and authorise payment.
12. Our standard of service and your statutory rights
We will provide services with reasonable care and skill. Information we give you about the service that you rely on is binding where the law says it is. If a service does not conform to the contract, you may have rights to repeat performance, a price reduction or other remedies.
Nothing in these terms excludes or restricts rights that cannot lawfully be excluded, including rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
13. Liability
We are responsible for loss or damage that is a foreseeable result of our breach of contract or failure to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, for pre-existing defects, or for deterioration we could not reasonably identify during a visual check.
Nothing in these terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be limited. This membership is for consumers; we are not liable for business losses such as loss of profit, revenue or opportunity.
14. Events outside reasonable control
We are not responsible for delay caused by events outside our reasonable control, such as severe weather, unsafe conditions, road closures, utility failures or sudden staff illness. We will contact you, minimise delay where reasonably possible and rearrange the service. If a significant delay means the service no longer has value to you, contact us to discuss cancellation and any refund due.
15. Personal information and payment records
We use personal information to set up and manage your membership, arrange work, take payment, meet legal obligations and handle enquiries or complaints. Stripe processes payments and keeps the checkout and consent record. Please read our Privacy Notice for more detail.
16. Changes to these terms
The terms you accept at checkout apply to your membership. We may change terms where required by law or to make a change that does not materially disadvantage you. We will explain any material change in writing before it takes effect. We will not increase the first-year total price or materially reduce an included benefit without your express agreement.
17. Complaints, law and courts
Please contact us first so we can investigate: info@homecaremaintenance.co.uk, 07904 790469, or the registered office address above. We aim to acknowledge complaints promptly and provide a substantive response within 14 days where reasonably possible.
These terms are governed by the law of England and Wales. If you live elsewhere in the UK, you keep any mandatory protections provided by the law where you live and may bring proceedings in your local courts. You may also obtain free consumer advice from the Citizens Advice consumer service.
If a court finds part of these terms unlawful, the remaining terms continue. A delay in enforcing a term does not waive it. Only you and HomeCare have rights under this contract.
